The website operator web-akzent gmbh
(hereinafter referred to as "we" or "us")
operates on
"www.creastop.com"
a Content Management System
(hereinafter referred to as "CMS").

The CMS is suitable for creating websites,
documentations and multimedia
presentations (hereinafter referred to
as "creation of projects").

The created projects are available for
immediate download, compressed in
a ZIP file.
For further processing of the project, the
downloaded ZIP file can be read into
the CMS.

The downloaded project can be published
by a provider of your choice.
The project can also be started locally
from the user's hard drive, independently
of a web server.

The use of the CMS is free of charge.
The following items are listed below:

Ownership and licensing of copyrighted
components of a project downloaded
from "www.creastop.com".

This text section
"Ownership and licensing . . ." is also
included in the file "read_me.htm", which
is attached to each downloaded project.

Definitions:
CMS = Content Management System on
"www.creastop.com"
Creater = CMS user
Project = downloaded project from
the CMS

All files are owned by the
creater and/or owner of the project with
the following restriction :
The copyrighted components of a project
described below are owned by
web-akzent gmbh, Switzerland
(see description item 3,4,5).

The creator and/or owner bears sole
responsibility for the project and has
the right to sell and/or to license with
a license of his choosing, to publish,
to distribute and to merge a project,
under the condition that the terms
of license for the copyrighted
components are respected and
not modified (see description item 3,4,5).

DESCRIPTION of the various components
of a project :
1) User generated content: User-inserted
elements such as text, fonts, images,
audios, videos, etc.
User generated content is owned by
the creater and/or owner of the project.
The creater and/or owner of the project
has the sole responsibility for
user-generated content and for
respecting any copyright of third parties
in the content.
2) HTM-files (*.htm): CMS generated files
based on user input.
3) Javascript-files (*.js): CMS generated
files (in folder "script_s/...").
The javascript-code in file "ak1.js"
is copyrighted.
4) PHP-file (*.php): CMS generated file
in case of a form implementation
(in folder "php_script/...").
The PHP-Code in file "forms.php"
is copyrighted.
5) Templates: sample objects provided
by the CMS, such as menus, tables,
images, favicons, audios, videos,
entire project templates, etc.
Templates are copyrighted.

LICENSING of the javascript-code in the
file "ak1.js" (see description item 3) :
web-akzent gmbh hereby grants
permission, free of charge, to any
person obtaining a copy of this
javascript-code, to redistribute and to
use the javascript-code under
the following conditions :
- The javascript-code must not be
modified, customized or added
with new code and must only be
used as a component of the
associated project downloaded
from the CMS.
- The javascript-code must include
the following copyright notice .

LICENSING of the PHP-code in the file
"forms.php" (see description item 4) :
web-akzent gmbh hereby grants
permission, free of charge, to any person
obtaining a copy of this PHP-code,

to customize, to merge, to copy the
PHP-code under the following conditions :
- The licensed PHP-code must only be
used as a component of a project
downloaded from the CMS.
- When changes are made, the new code
must be marked and the author or rights
holder of the new code must be
documented in the same file of the
licensed PHP-code.
- The following copyright notice must be
included in the file with the
licensed PHP-code.

LICENSING of the templates

permission, free of charge, to any
person obtaining copies of the
templates, to redistribute, to use,
to modify, to merge, to copy the

- The templates must only be used
as components of a project
downloaded from the CMS.


THE COPYRIGHTED COMPONENTS
JAVASCRIPT-CODE, PHP-CODE AND
TEMPLATES, HEREINAFTER REFERRED
TO AS THE LICENSED COMPONENTS,
ARE PROVIDED "AS IS", WITHOUT
WARRANTY OF ANY KIND, EXPRESS
OR IMPLIED, INCLUDING BUT NOT
LIMITED TO THE WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE AND
NONINFRINGEMENT. IN NO EVENT
SHALL THE AUTHORS OR COPYRIGHT
HOLDERS BE LIABLE FOR ANY CLAIM,
DAMAGES OR OTHER LIABILITY,
WHETHER IN AN ACTION OF
CONTRACT, TORT OR OTHERWISE,
ARISING FROM, OUT OF OR IN
CONNECTION WITH THE LICENSED
COMPONENTS OR THE USE OR
OTHER DEALINGS IN THE LICENSED

Responsibilities and restrictions when
using Web Real Time Communication
(= WebRTC)
For a project collaboration, it is possible
to connect to one or several participants
and to transmit audio, video and data
in real-time.

Sending project pages or entire projects
is supported. The CMS users are solely
responsible for respecting any existing
copyrights of third parties in the sent
content.

Configurations of the routers and
firewalls at the participants may not
allow a direct browser-to-browser
connection.
In this case, the WebRTC specifications
allow the use of a relay server
(= TURN server).
We only enable direct browser-to-browser
connections, i.e. we have not implemented
a TURN server. Establishing a connection
to another participant is therefore
not always possible.

We try to our best efforts to ensure this
communication option as smoothly as
possible, however, we do not guarantee
uninterrupted and error-free service.

Our servers are only needed for
establishing the connection according
to the WebRTC specifications.
We do not collect any personal data
in connection with WebRTC and are not
able to draw any conclusions to the
connection and its participants. We have
absolutely no access to the encrypted
browser-to-browser connection.
The two participants are solely
responsible for their communication.
Users agree to use this communication
option for lawful purposes only.
Limitations of warranty and liability
Despite every care, we do not provide any
guarantee or liability, to the extent
permitted by applicable law, for the
topicality, correctness, completeness and
quality of our service and the information
provided on our website.

The information, such as explanations,
recommendations and video tutorials,
reflects only our opinion and we are
aware that other solutions may be more
suitable for you.

The downloaded projects can be shown
with the current web browser generation.
The web browsers of the various
manufacturers are developed to different
extents and are constantly being further
developed.
We can therefore not guarantee that the
downloaded projects will run error-free
in any environment and in future uses.
We recommend that you thoroughly
test the projects in the intended
environment before publishing
(e.g. different web browsers, web servers).

When making changes to our CMS, we
place great emphasis on compatibility
with projects already downloaded by users.
However, we do not assume any liability for
an error-free import process of an existing
project into the CMS and for the availability
of the entire range of functions of the old
project after a new download.

The CMS enables the creation of forms. In
the case of a form implementation, the CMS
automatically creates a PHP script.
This PHP script contains all the data of the
created form and the functionality for
sending the form input to an email address
(form-to-email).
We are aware that embedding scripts on
the web server raises questions about
privacy, stability and security of a website,
and the compatibility of the server software.
We recommend that the user contacts his
provider or a programmer to clarify these
questions. Responsibility for using this
PHP script lies solely with the user.

The creation of a project takes place locally
in the user's webbrowser and independently
of our servers with regard to the content
generated by the user. Our servers do not
store user-generated content, i.e. we do
not have access to the user's content
at any time.
The responsibility for the downloaded
project and the observance of possible
copyrights of third parties in the content
lies solely with the creater and/or owner.
We therefore disclaim any liability in
connection with user-generated content.
Users agree to use the CMS for lawful
purposes only.
Changes to our website
We reserve the right, at any time and
without notice, to modify or temporarily or
permanently discontinue the website.
Changes or additions are subject to these
Terms of Use as of the date of their
publication on our website.
Changes to these Terms of Use
We reserve the right to modify the Terms
of Use at any time without advance notice.
Changes to our website, our users' needs,
our business priorities or changes in the
law may make this necessary. The changes
will become effective by posting the new
terms on our Website with the date of
modification.

In case of a conflict between the new
terms in the text section
"Ownership and licensing . . ."
on the website and the old terms included
in the downloaded file "read_me.htm"
of the existing project, the old terms
in file "read_me.htm" take precedence.
Existing projects that are read into the
CMS and downloaded again are subject
to the new Terms of Use.
